This literature review aims to describe the concept and structure of advance directives and the ethical aspects involved in patient care. Using the keywords “Advance Healthcare Directive” AND “Ethical Implication” and its Spanish equivalents, five databases were accessed: ProQuest, Philosophy, (...) PubMed, Web of Science and Scielo. Publications were narrowed down to the 2010-2018 period. Thirty-one articles were obtained and read critically. Results of this review were grouped into the following categories: concept, structure, clinical situations in which advance directives apply, strengths and limitations, as well as the ethical aspects involved. End of life-related experiences in which a person loses their ability to make decisions and cannot express their wishes, so it is impossible to know their will, are more common nowadays. Most health workers are not appropriately trained in the preparation and application of advance directives, which becomes an opportunity to research and delve deeper into the subject. Advance directives are a tool that gives health workers reliable information on a patient’s values and wishes, so it is vital to train them to provide respectful quality care. In a recent opinion paper, it was argued that individuals with multiple retractions or a record of academic misconduct should not serve as editors, including as editors-in-chief, on the editorial boards of scholarly or academic journals. As a first step towards appreciating how such a policy could be applied in practice, the presence of 30 individuals listed on the Retraction Watch Leaderboard on editorial boards was screened. Six cases are highlighted to gain an appreciation of the potential reputational risks that (...) journals and publishers might incur by including individuals with a tainted academic record on editorial boards. Given the reputational, legal and other risks associated with this type of assessment and decision, more formal positioning and guidance are needed by global ethics policy-related bodies such as COPE, the ICMJE, and the CSE, even more so in journals that claim to follow these organizations’ ethical guidelines. This text presents some elective affinities and differences between the works of two powerful media theoreticians of the 20th century: Water Benjamin and Vilém Flusser. Both authors have shaped original perspectives on the relationship between art and technology. While holding a special place for the theory of photography, both have reflected upon the history of writing and its transformations during Modernity. In addition, both Benjamin and Flusser dedicated important texts to the question of translation and the philosophy of language. A partir destes autores já não se pode falar de uma obra de arte desvinculada da reflexão sobre ela, mas, por sua vez, a própria "critica" deve se tomar arte.

In the present work we propose to present the way in which Heidegger treats the concept of anguish in his inaugural class What is Metaphysics?, emphasizing the relation between the awakening of anguish and the revelation of being. At the same time, we propose to confront the treatment of the concept of anguish in the lecture and the one that Heidegger gives to the concept in Being and Time. Indeed, in his lecture Heidegger presents anguish as a manifestation of nothingness, (...) in which the revelation of the being as such to the Dasein occurs. On the other hand, in § 40 of Being and Time Heidegger presents anguish as the disposition that removes Dasein from de-cadence and singularizes it, that is, places it before itself. With this, we will show the unfolding of the concept of anguish, from the most existential approach of the major treatise to the more ontological perspective of the lecture. (shrink)

Making research data readily accessible during a public health emergency can have profound effects on our response capabilities. The moral milieu of this data sharing has not yet been adequately explored. This article explores the foundation and nature of a duty, if any, that researchers have to share data, specifically in the context of public health emergencies. There are three notable reasons that stand in opposition to a duty to share one’s data, relating to: (i) data property and ownership, (ii) (...) just distribution of benefits and burdens and (iii) the contemporary ethos of science. We argue each reason can be successfully met with corresponding rationale in favour of data sharing. Further support for data sharing has been echoed in policies of health agencies, funding bodies and academic institutions; in documents on the ethical conduct of biomedical research; and in discussions on the nature of public health. From this, we ascertain that sharing data is the morally sound default position. This article then highlights the key roles reciprocity and solidarity play in supporting the practice of data sharing. We conclude with recommendations to regard public health research data as a common-pool resource in order to build a framework for stable data sharing management. (shrink)

The Extended Evolutionary Synthesis (EES) debate is gaining ground in contemporary evolutionary biology. In parallel, a number of philosophical standpoints have emerged in an attempt to clarify what exactly is represented by the EES. For Massimo Pigliucci, we are in the wake of the newest instantiation of a persisting Kuhnian paradigm; in contrast, Telmo Pievani has contended that the transition to an EES could be best represented as a progressive reformation of a prior Lakatosian scientific research program, with the extension (...) of its Neo-Darwinian core and the addition of a brand-new protective belt of assumptions and auxiliary hypotheses. Here, we argue that those philosophical vantage points are not the only ways to interpret what current proposals to ‘extend’ the Modern Synthesis-derived ‘standard evolutionary theory’ (SET) entail in terms of theoretical change in evolutionary biology. We specifically propose the image of the emergent EES as a vast network of models and interweaved representations that, instantiated in diverse practices, are connected and related in multiple ways. Under that assumption, the EES could be articulated around a paraconsistent network of evolutionary theories (including some elements of the SET), as well as models, practices and representation systems of contemporary evolutionary biology, with edges and nodes that change their position and centrality as a consequence of the co-construction and stabilization of facts and historical discussions revolving around the epistemic goals of this area of the life sciences. We then critically examine the purported structure of the EES—published by Laland and collaborators in 2015—in light of our own network-based proposal. Finally, we consider which epistemic units of Evo-Devo are present or still missing from the EES, in preparation for further analyses of the topic of explanatory integration in this conceptual framework. Contemporary evolutionary biology comprises a plural landscape of multiple co-existent conceptual frameworks and strenuous voices that disagree on the nature and scope of evolutionary theory. Since the mid-eighties, some of these conceptual frameworks have denounced the ontologies of the Modern Synthesis and of the updated Standard Theory of Evolution as unfinished or even flawed. In this paper, we analyze and compare two of those conceptual frameworks, namely Niles Eldredge’s Hierarchy Theory of Evolution (with its extended ontology of evolutionary entities) and (...) the Extended Evolutionary Synthesis (with its proposal of an extended ontology of evolutionary processes), in an attempt to map some epistemic bridges (e.g. compatible views of causation; niche construction) and some conceptual rifts (e.g. extra-genetic inheritance; different perspectives on macroevolution; contrasting standpoints held in the “externalism–internalism” debate) that exist between them. This paper seeks to encourage theoretical, philosophical and historiographical discussions about pluralism or the possible unification of contemporary evolutionary biology. (shrink)

A fenomenologia encontra-se em um momento crítico, enquanto investigadores reinterpretam textos canônicos e reverenciados de Edmund Husserl, Martin Heidegger e Maurice Merleau-Ponty para tentar demonstrar sua importância política e ética. Mais especificamente, os fenomenólogos desejam demonstrar a relevância da fenomenologia para as análises críticas das diversas identidades sociais. Devido aos compromissos metodológicos com o método transcendental, uma predileção por evidências apodíticas, o apelo para a suspensão da atitude natural e a busca por categorias ontológicas gerais, os investigadores contemporâneos não reconheceram (...) imediatamente a fenomenologia como uma fonte provável para teorizar as estruturas históricas e contingentes. Talvez o problema seja que a própria Filosofia em si, como observa Helen Ngo (2019), tem “uma tendência bem conhecida em direção à abstração e à conceitualização que pode dificultar o reconhecimento da natureza profundamente histórica e da especificidade situada do racismo” (p. 207; grifo nosso). De fato, a descrição de Ngo sobre o “acerto de contas” da raça pela Filosofia é muito apropriada; a Filosofia precisa confrontar suas práticas de omissão e supressão ou, em resumo, seu racismo. Certamente, uma filosofia como a fenomenologia, que leva a sério a experiência vivida e o mundo da vida, precisa teorizar a raça como uma característica fundamental da experiência vivida e da criação de sentidos. Não fazer isso indicaria um profundo fracasso em se envolver com o famoso “problema da linha de cor” que W. E. B. Du Bois (1989) entendeu tão agudamente como o principal problema do século XX, mas que claramente continua a nos assombrar. (shrink)

This paper explores that the topic of ethics dumping, its causes and potential remedies. In ED, the weaknesses or gaps in ethics policies and systems of lower income countries are intentionally exploited for intellectual or financial gains through research and publishing by higher income countries with a more stringent or complex ethical infrastructure in which such research and publishing practices would not be permitted. Several examples are provided. Possible ED needs to be evaluated before research takes place, and detected prior (...) to publication as an academic paper, because it might lead to a collaborative effort between a wealthier country with restrictive ethical policies and a less wealthy country with more permissive policies. Consequently, if that collaboration ultimately results in an academic paper, there are ethical ramifications of ED to scholarly communication. Institutional review board approval is central to avoid ED-based collaborations. Blind trust and goodwill alone cannot eliminate the exploitation of indigenous or “vulnerable” populations’ intellect and resources. Combining community-based participatory research using clear codes of research conduct and a simple but robust verification system in academic publishing may reduce the risks of ED-based research from being published. This book seeks to arrive at a better understanding of the relationships between the objective and subjective aspects of time. It discusses the existence of fluent time, a controversial concept in many areas, from philosophy to physics. Fluent time is understood as directional time with a past, a present and a future. We experience fluent time in our lives and we adopt a temporal perspective in our ways of knowing and acting. Nevertheless, the existence of fluent time has been debated (...) for both philosophical and scientific reasons, thus creating a rift between the subjective and objective aspects of time. Starting from the basic notion of points of view, or perspectives, this book explores the relationships between objective or external time, as it has been conceptualized by science, and subjective or internal time, which is involved in our lived experiences. It establishes a general framework encompassing the nature, structure and mode of existence of points of view, in which the objective and subjective aspects of time can be integrated. The book mainly addresses researchers and postgraduates in philosophy and logic. Additionally, it offers inspiration for physicists and computer scientists involved in the modeling and simulation of complex behaviors for which the representation of internal time should be considered together with the notion of objective, external time. The contention that medical artificial intelligence (AI) should be ‘explainable’ is widespread in contemporary philosophy and in legal and best practice documents. Yet critics argue that ‘explainability’ is not a stable concept; non-explainable AI is often more accurate; mechanisms intended to improve explainability do not improve understanding and introduce new epistemic concerns; and explainability requirements are ad hoc where human medical decision-making is often opaque. A recent ‘political response’ to these issues contends that AI used in high-stakes scenarios, including medical (...) AI, must be explainable to meet basic standards of legitimacy: People are owed reasons for decisions that impact their vital interests, and this requires explainable AI. This article demonstrates why the political response fails. Attending to systemic considerations, as its proponents desire, suggests that the political response is subject to the same criticisms as other arguments for explainable AI and presents new issues. It also suggests that decision-making about non-explainable medical AI can meet public reason standards. The most plausible version of the response amounts to a simple claim that public reason demands reasons why AI is permitted. But that does not actually support explainable AI or respond to criticisms of strong requirements for explainable medical AI. (shrink)

Publishing has become, in several respects, more challenging in recent years. Academics are faced with evolving ethics that appear to be more stringent in a bid to reduce scientific fraud, the emergence of science watchdogs that are now scrutinizing the published literature with critical eyes to hold academics, editors and publishers more accountable, and a barrage of checks and balances that are required between when a paper is submitted and eventually accepted, to ensure quality control. Scientists are often under increasing (...) pressure to produce papers in an increasingly stringent publishing environment. In such a climate, timing is everything, as is the efficiency of the process. Academics appreciate that rejections are part of the fabric of attempting to get a paper published, but they expect the reason to be clear, based on careful evaluation of their work, and not on superficial or unsubstantiated excuses. A desk rejection occurs when a paper gets rejected even before it has entered the peer review process. This paper examines the features of some desk rejections and offers some guidelines that would make desk rejections valid, fair and ethical. Academics who publish are under constant pressure to do so quickly, but effectively. They are dependent on the editors’ good judgment and the publisher’s procedures. Unfair, unsubstantiated, or tardy desk rejections disadvantage academics, and editors and publishers must be held accountable for wasting their time, resources, and patience. (shrink)

This opinion paper takes aim at an error made recently by Clarivate Analytics in which it sent out an email that congratulated academics for becoming exclusive members of academia’s most cited elite, the Highly Cited Researchers. However, that email was sent out to an undisclosed number of non-HCRs, who were offered an apology shortly after, through a bulk mail, which tried to down-play the importance of the error, all the while praising the true HCRs. When Clarivate Analytics senior management was (...) contacted, the company declined to offer an indication of the number of academics who had been contacted and erroneously awarded the HCR status. We believe that this regrettable blunder, together with the opacity offered by the company, fortify the corporate attitude about the value of the journal impact factor, and what it represents, namely a marketing tool that is falsely used to equate citations with quality, worth, or influence. The continued commercialization of metrics such as the JIF is at the heart of their use to assess the “quality” of a researcher, their work, or a journal, and contributes to a great extent to driving scientific activities towards a futile endeavor. The study of perception and the role of the senses have recently risen to prominence in philosophy and are now a major area of study and research. However, the philosophical history of the senses remains a relatively neglected subject. Balancing implies a comparison among goods, values, principles and rights that cannot be ranked on a single scale of measurement, ie there is no unequivocal measuring unit applicable to all of them. In such situations, it is common to state that one has to compare incommensurable things. Indeed, this issue has been mentioned by several authors as a strong reason in favour of abandoning balancing (and proportionality) as a rational form of judicial argumentation and decision-making. My article aims at arguing (...) that this objection is based on fallacious assumptions concerning the relations among three concepts: incommensurability, incomparability and balancing. Initially, what is at stake is the analysis of the connection between comparing values (or principles) and commensurability. The results of this initial analysis were then used to provide greater analytical strength to the specific debate on balancing and comparing rights in order to show that incommensurability does not imply incomparability and that rational decisions are possible even when incommensurable values are at stake. Since balancing (and proportionality) implies comparisons, and since constitutional principles are doubtlessly incommensurable (for there is no common metric to measure them), arguing for the comparability of incommensurable principles is an unavoidable step if one aims at demonstrating that balancing may be a rational procedure after all. This article intends to explore the philosophical potency in the work of the black writer Carolina Maria de Jesus (1914-1977). Carolina de Jesus is best known for her work Quarto de Despejo, diary of a favelada (1960), our approach, however, focuses specifically on her short story “Socrates Africano”, in which she deals with her experience with her grandfather Benedito and the relationship between her wisdom and that of the Greek philosopher Sócrates (5th century BC). Her reflection starts from the attempt (...) to understand the reason why her grandfather was compared to Socrates and called “African Socrates”. In this sense, we intend to expand the idea of an African Socrates and the origins of one of the African philosophical matrices, the Yoruba tradition, dialoguing with the thought of the Nigerian philosopher Sophie Oluwole (1935-2018) and her approximation between Socrates and Orunmilá, as a motto to think about the philosophical potentialities of Carolina's work and the traits of an Afro-Brazilian philosophy. Editors have increasing pressure as scholarly publishing tries to shore up trust and reassure academics and the public that traditional peer review is robust, fail-safe, and corrective. Hidden conflicts of interest may skew the fairness of the publishing process because they could allow the status of personal or professional relationships to positively influence the outcome of peer review or reduce the processing period of this process. Not all authors have such privileged relationships. In academic journals, editors usually have very specialized (...) skills and are selected as agents of trust, entrusted with the responsibility of serving as quality control gate-keepers during peer review. In many cases, editors form extensive networks, either with other professionals, industry, academic bodies, journals, or publishers. Such networks and relationships may influence their decisions or even their subjectivity towards a set of submitting authors, paper, or institute, ultimately influencing the peer review process. These positions and relationships are not simply aspects of a curriculum, they are potential COIs. Thus, on the editorial board of all academic journals, editors should carry a COI statement that reflects their past history, as well as actual relationships and positions that they have, as these may influence their editorial functions. Authors endure considerable hardship carrying out biomedical research, from generating ideas to completing their manuscripts and submitting their findings and data (as is increasingly required) to a journal. When researchers submit to journals, they entrust their findings and ideas to editors and peer reviewers who are expected to respect the confidentiality of peer review. Inherent trust in peer review is built on the ethical conduct of authors, editors and reviewers, and on the respect of this confidentiality. If such confidentiality is (...) breached by unethical reviewers who might steal or plagiarize the authors’ ideas, researchers will lose trust in peer review and may resist submitting their findings to that journal. Science loses as a result, scientific and medical advances slow down, knowledge may become scarce, and it is unlikely that increasing bias in the literature will be detected or eliminated. In such a climate, society will ultimately be deprived from scientific and medical advances. Despite a rise in documented cases of abused peer review, there is still a relative lack of qualitative and quantitative studies on reviewer-related misconduct, most likely because evidence is difficult to come by. Our paper presents an assessment of editors’ and reviewers’ responsibilities in preserving the confidentiality of manuscripts during the peer review process, in response to a 2016 case of intellectual property theft by a reviewer. Our main objectives are to propose additional measures that would offer protection of authors’ intellectual ideas from predatory reviewers, and increase researchers’ awareness of the responsible reviewing of journal articles and reporting of biomedical research. This article offers a new understanding of populism. The argument unfolds as follows: first, the populist literature is reviewed and two main approaches are identified: ontic and logic-oriented, the more important of which is the Schmitt-Laclau logic of enmity. While the authors broadly agree with Laclau’s criticism of ontic approaches, they endorse neither his ontological understanding of enmity, nor his claim that populism is politics, and enmity is the logic of populism. Next, the origins of populism are located in a (...) paradox at the heart of democracy. Democracy defines itself as a community of inclusion, yet exclusion is constitutive of inclusion, including therefore democratic inclusion. Then is discussed what the authors believe to be the true logic of populism: resentment. Unlike enmity, which functions in Laclau’s populist theory as an ontology of non-identity, resentment operates within a rivalrous framework, which presupposes identification between the parts and refers to a set of normative commitments. Finally, the article concludes by presenting an understanding of populism as a specific logic of political action. (shrink)

COVID-19-related controversies concerning the allocation of scarce resources, travel restrictions, and physical distancing norms each raise a foundational question: How should authority, and thus responsibility, over healthcare and public health law and policy be allocated? Each controversy raises principles that support claims by traditional wielders of authority in “federal” countries, like federal and state governments, and less traditional entities, like cities and sub-state nations. No existing principle divides “healthcare and public law and policy” into units that can be allocated in (...) intuitively compelling ways. This leads to puzzles concerning (a) the principles for justifiably allocating “powers” in these domains and (b) whether and how they change during “emergencies.” This work motivates the puzzles, explains why resolving them should be part of long-term responses to COVID-19, and outlines some initial COVID-19-related findings that shed light on justifiable authority allocation, emergencies, emergency powers, and the relationships between them. This work offers a new democratic case for federalism, understood as a form of governance in which multiple entities in a country possess final decision-making authority (viz., can make decisions free from others substituting their decisions, issuing fines, etc.) over at least one subject (e.g., immigration, defense). It argues that leading solutions to the democratic boundary problem provide overlapping arguments for federalism. The underlying logic and many details of the most commonly cited solutions focused on those relevantly affected by and (...) subject to decisions each support three distinct arguments (focused on voteshares, other forms of democratic influence, and persistent minorities) for multiple demoi possessing authority in a polity. Federalism is the best available method for recognizing the distinct demoi. This not only supports federal governance as opposed to unitary governance and subsidiarity. It also suggests that democracy and federalism are importantly related and have several implications for institutional design. (shrink)

Esse artigo apresenta os resultados de uma pesquisa de imagens nos arquivos da ditadura brasileira, para a realização de um filme documentário histórico. As estratégias políticas de acesso aos documentos do período e os procedimentos estéticos desenvolvidos na montagem para a valorização desses acervos são, aqui, analisados, com o intuito de extrair dessa experiência empírica ensinamentos sobre a escrita da história no cinema.

The blogosphere is full of personalities with masks, or pseudonyms. Although not a desired state of public communication, one could excuse the use of pseudonyms in blogs and social media, which are generally unregulated or weakly regulated. However, in science publishing, there are increasingly strict rules regarding the use of false identities for authors, the lack of institutional or contact details, and the lack of conflicts of interest, and such instances are generally considered to be misconduct. This is because these (...) violations of publishing protocol decrease trust and confidence in science and bring disrepute to those scientists who conform to the rules set out by journals and publishers and abide by them. Thus, when cases are encountered where trust and protocol in publishing are breached, these deserve to be highlighted. Neste artigo, temos como objetivo um paralelismo epistemológico entre a integração de conceitos (FAUCONNIER; TURNER, 2002) e a eficiência de uma máquina termodinâmica (CARNOT, 1824). Nossa hipótese é a de que o comportamento linguístico equivalha a um sistema adaptativo complexo (DUQUE, 2016),com eficiência máxima em seus processos comunicativos,tal qual uma máquina termodinâmica. Com base em nosso objeto,a saber, as redes de integração conceptual (SILVA, 2019), percebemos que o ser humano mistura conceitos a partir de muitas frentes de informação (frames) (...) e compõe uma estrutura conceptual nova, fruto da amálgama de informações desses frames. Assim, baseando-nos emum método qualitativo, apoiado na visão de Silverman (2000), concluímos que a rede de integração conceptual funciona de forma semelhante a uma máquina térmica de Carnot, na qual elementos são processados de forma a garantir a máxima eficiência.Palavras-chave: Integração conceptual. AbstractIn this article, we aim at an epistemological parallelism between the conceptual blending (FAUCONNIER; TURNER, 2002) and the efficiency of a thermodynamic machine (CARNOT, 1824). Our hypothesis is that linguistic behavior amounts to a complex adaptive system (DUQUE, 2016) with maximum efficiency in its communicative processes in the same way as a thermodynamic machine. Supported by our object, namely the conceptual integration networks (SILVA, 2019), we perceive that the human being mixes concepts from many information fronts (frames) and composes a new conceptual structure, resulting from the amalgamation of information from these frames. Thus, based on the qualitative method supported by Silverman's (2000) vision, we conclude that the conceptual integration network works similarly to a Carnot thermal machine, in which elements are processed in order to ensure maximum efficiency.Keywords: Conceptual blending. The concept of corporal image includes how own body, taking into account their constituent parts, as well as the feelings related the those characteristics. The entrance in academica life provokes alterations in the feeding behavior, and the exposition to the new social environment they can bring as consequence an increase in dissatisfaction. Objective: To investigate the satisfaction with the body image and eating behavior of academics at a university center. Methods: For data collection, the following instruments were used. The evaluation (...) was performed with anthropometric measurements, as size and weight measurements. In order to diagnose the nutritional status, the body mass index was used. In order to evaluate the study variables; we used the Body Checking questionnaires Questionnaire. Male Body Checking Questionnaire, Body Shape Questionnaire and EAT-26. Results: According to the Body Mass Index, the female gender had a higher rate of adequacy (70.4%), in relation to the masculine (58,9%). The EAT-26 questionnaire showed that 85% of male engineering students presented risk for Feeding Disorders, in relation to the female psychology (89.8%). Conclusion: In terms of feeding behavior, the women scored higher than men, which suggests a higher susceptibility to Feeding Disorders development in men. (shrink)

A partir de uma pesquisa bibliográfica de caráter qualitativo, este artigo busca identificar o potencial do relato de reformular a teoria moral da dignidade humana, tornando a normatividade dela decorrente sensível às peculiaridades das minorias sociais. Este trabalho, dentre várias outras produções, tem como referencial teórico principal a obra Torture and Dignity: An Essay on Moral Injury (2015), de Jay Bernstein, além de utilizar, para fins de compreensão do caráter intergeracional do relato, o livro O que os cegos estão sonhando? (...) (2012), organizada por Noemi Jaffe. Estabelecido tal panorama, busca-se discutir a hipótese de que o relato possui funções subjetivas, morais e sociais que, juntas, são capazes de fazer com que o indivíduo retome o controle de seu corpo após experiências de degradação, senso de corporeidade esse que, ao tornar igualmente relevantes os aspectos voluntário e involuntário do ser, tornam contextuais as concepções de dignidade humana e de Direitos Humanos.
